HARRISBURG – The state House today approved legislation amending the Unemployment Compensation (UC) law by adding clarification of claimants discouraging their own hire, said Rep. Shelby Labs (R-Bucks), who authored the measure.
“We want Pennsylvanians to be seeking employment and actively engaging in the hiring process to obtain employment,” Labs said. “Sadly, this is not always the case. My office and others have received numerous complaints from employers who note that applicants have told them they are only applying for jobs to fulfil UC job search requirements or simply just don’t show up to the interview.”
House Bill 1819 would provide clarification to the UC law that claimants may not take actions to discourage their own hire. Prohibited actions include failure or refusal to attend a job interview or other applicant selection activity without good cause; refusing a job prior to an interview or a discussion of the details of a job with the employer without good cause; or failing to make a good faith effort to obtain employment, as evidenced by any statement or other actions of the claimant intended to discourage the claimant’s hire.
The legislation would also require the Department of Labor and Industry create forms, or update existing forms, to enable employers to report claimants who discourage their own hire in order to receive unemployment benefits.
House Bill 1819 now goes to the Senate for consideration.
